1. About PikMe
PikMe (“PikMe”, “we”, “us” or “our”) is a social discovery application designed to help people notice and express interest in others they encounter in everyday life.
PikMe allows users to create simple drawings, share descriptions or tags relating to their appearance or outfit, discover other users within a permitted nearby area, and express interest through nudges. Where two users have mutually expressed interest, additional messaging features may become available.
These Terms and Conditions (“Terms”) govern your access to and use of the PikMe mobile application, website and related services (collectively, the “Service”).
By creating an account, accessing or using PikMe, you agree to these Terms. If you do not agree, you must not use the Service.

3. Eligibility and age requirements

You must not misrepresent your age or help another person bypass our eligibility requirements.
4. Your account
You may need to create an account to access certain features.
You are responsible for maintaining the security of your account and for activities carried out through it, except where applicable law provides otherwise.
You agree to:

Keep your login credentials secure.
Notify us if you suspect unauthorised access to your account.
Maintain only the accounts permitted by our registration rules.
Avoid impersonating another person or creating accounts for deceptive purposes.
PikMe is not designed around traditional public user profiles. However, the content you submit and the information you choose to share may be visible to other users according to the Service's features and settings.
You should not assume that anything shared through PikMe is private unless the relevant feature explicitly states otherwise.
5. How PikMe works
PikMe is designed to support lightweight social discovery without requiring users to maintain a conventional public social media profile.
Depending on the features available in your version of the Service, you may be able to:
Create a drawing representing yourself, your outfit or an item you wish to share.
Add tags describing your appearance, clothing or style.
Discover content shared by users in a permitted nearby area.
Send a nudge to express interest in another user's content.
Receive nudges from other users.
Unlock additional messaging features following a mutual nudge.
Access paid features or subscription options where offered.
We may introduce, modify, suspend or discontinue features as PikMe develops. Where a change affects a paid service or your statutory rights, we will comply with applicable legal requirements.
We do not guarantee that a particular person will appear in your nearby results, see your content, respond to your nudge or become available for messaging.
6. User content
“User Content” means any drawing, image, tag, text, message or other material you submit, upload, transmit or make available through PikMe.
You retain ownership of the intellectual property rights you hold in your User Content.
By submitting User Content, you grant PikMe a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, distribute and process that content to the extent reasonably necessary to operate, provide, maintain, secure and improve the Service.
This licence continues for as long as reasonably necessary for those purposes, including any applicable retention period following removal of the content. It does not transfer ownership of your content to PikMe.
You confirm that:
You own your User Content or have the permissions necessary to submit it.
Your content does not infringe another person's intellectual property, privacy or other legal rights.
You will not submit content that is unlawful, threatening, abusive, discriminatory, sexually exploitative or otherwise prohibited by these Terms.
You will not upload another person's identifiable image or personal information without an appropriate lawful basis and any necessary permission.
Your content will not be used to harass, threaten, shame or intimidate another person.
You must not use PikMe to publish intimate images without consent, sexual content involving minors, non-consensual personal information or content intended to facilitate stalking or physical harm.
7. Drawings and outfit tags
PikMe allows users to represent themselves or describe their appearance using drawings and tags.
You must ensure that your drawings and tags comply with these Terms.
You must not use drawings or tags to:
Depict explicit sexual acts or sexual exploitation.
Threaten, humiliate or target another individual.
Promote hatred or violence against protected groups.
Impersonate another person in a deceptive or harmful way.
Share another person's private or identifying information.
Circumvent our moderation or safety systems.
PikMe may remove content or restrict features where reasonably necessary to enforce these Terms, protect users or comply with applicable law.
8. Nearby discovery and location
PikMe may use location information to help determine which content is relevant to your nearby area.
Where applicable, location access is controlled through your device permissions and PikMe settings.
You acknowledge that:
Nearby results may be approximate, delayed, incomplete or unavailable.
Location accuracy depends on your device, permissions, network and the Service's technical capabilities.
Other users may infer general information about your whereabouts from content or nearby activity.
You should not share your home address, workplace address, daily routine or other sensitive location details through drawings, tags or messages.
We will process personal data in accordance with our Privacy Policy and applicable data protection law.
We do not guarantee that nearby discovery will always be accurate or that every person appearing in nearby results is physically present at the location you might expect.
You can manage device-level location permissions through your device settings, although disabling them may affect certain features.
9. Nudges and messaging
A nudge is a feature that allows you to express interest in another user or their shared content.
PikMe may provide free nudges and allow additional messaging features after both users have nudged each other.
You agree that:
Nudges must not be used to harass, intimidate or repeatedly target another user.
Mutual interest does not constitute consent to sexual activity, an in-person meeting or any other conduct outside the Service.
You must respect another person's decision not to respond.
You must not use messages to threaten, blackmail, defraud or exploit another user.
You must not attempt to obtain another user's private information through deception or coercion.
We may limit, suspend or remove messaging privileges where necessary to protect users or enforce these Terms.
We do not guarantee message delivery, message availability or that another user will respond.
10. Community standards and prohibited conduct
You must use PikMe lawfully, respectfully and in a manner that does not compromise the safety of others.
You must not:
Harass, stalk, threaten, intimidate or repeatedly contact another person against their wishes.
Engage in hate speech, discriminatory abuse or threats of violence.
Share unlawful, exploitative or non-consensual sexual content.
Use the Service to facilitate trafficking, exploitation, fraud or other criminal activity.
Impersonate another person or misrepresent your intentions to deceive users.
Attempt to identify, track or locate another user outside the intended functionality of the Service.
Scrape, harvest or collect other users' data without our authorisation.
Reverse engineer, interfere with or attempt to compromise the Service, except to the extent applicable law permits.
Circumvent account restrictions, moderation measures or security controls.
Use automated systems, bots or scripts to manipulate activity without our permission.
Use PikMe to advertise, solicit payments or promote commercial activity without our authorisation.
Encourage or assist another person to engage in prohibited conduct.
We may investigate suspected violations and take proportionate action in accordance with applicable law and our moderation procedures.
11. Safety and meeting other users
PikMe is a social discovery service. We cannot independently verify every user's identity, intentions, statements or behaviour.
If you choose to meet another user in person, you do so at your own discretion and risk.
We recommend that you:
Meet in a public place.
Arrange your own transport.
Tell someone you trust about your plans.
Avoid sharing financial details, passwords or sensitive personal information.
Leave immediately if you feel uncomfortable or unsafe.
You are responsible for your decisions and conduct when interacting with other users, subject to any duties PikMe has under applicable law.
If you believe you are in immediate danger, contact the relevant emergency services.
12. Reporting, blocking and moderation
We may provide reporting, blocking or other safety tools within the Service.
You should use the available reporting tools to notify us of content, messages, accounts or conduct that you reasonably believe violates these Terms or applicable law.
When we receive a report, we may review the relevant information, restrict access to content, limit an account, suspend messaging privileges or take other appropriate action.
We may also act on information identified through our own monitoring or received from lawful authorities.
We will assess reports in accordance with our policies and applicable legal obligations. We do not guarantee that every report will result in removal or account termination.
Where required by law, we will provide appropriate information about significant moderation decisions and available complaint or appeal mechanisms.
Nothing in these Terms removes any rights you may have to make a complaint to a relevant regulator or seek a legal remedy.
13. Free and paid features
PikMe may provide both free and paid functionality.
The features available to you will depend on the version of the Service, your account status and any subscription or purchase you have made.
Before completing a purchase, we will provide the applicable price, billing frequency, duration and other material terms.
We may change our pricing or feature packages in the future. Changes to existing paid subscriptions will be handled in accordance with applicable law and any applicable subscription terms.
You must not attempt to access paid features without payment where payment is required.
14. Subscriptions, payments and renewals
If PikMe offers subscriptions, the applicable price, billing period, renewal terms and included features will be disclosed before purchase.
Where a subscription is purchased through Apple's App Store or Google Play, payment, renewal, cancellation and refund procedures may be governed by the relevant store's terms and processes.
You are responsible for managing your subscription through the relevant purchase channel.
Unless the applicable offer states otherwise:
A subscription may renew automatically at the end of its billing period.
You must cancel before the renewal date to prevent the next renewal charge.
Cancelling a subscription generally prevents future renewals but does not automatically refund amounts already paid.
Access to paid features may continue until the end of the current paid period, subject to the applicable terms.
Your statutory cancellation and refund rights remain unaffected. Where you purchase directly from PikMe, any applicable consumer cancellation rights and refund arrangements will be explained at the point of purchase.
Nothing in this section excludes a refund or other remedy required by law.
15. Intellectual property
PikMe and its associated branding, design, software, interfaces, graphics, trademarks and other materials are owned by or licensed to PikMe, except for User Content and third-party materials.
We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Service for its intended purpose in accordance with these Terms.
You must not copy, distribute, modify, sell, sublicense or commercially exploit PikMe's materials without our prior written permission, except where applicable law permits.
Nothing in these Terms transfers ownership of PikMe's intellectual property to you.
16. Availability and changes to the Service
We aim to keep PikMe available and functioning reliably, but we do not guarantee uninterrupted access.
The Service may be temporarily unavailable due to maintenance, updates, technical problems, security incidents, third-party failures or circumstances beyond our reasonable control.
We may update or change the Service to improve functionality, security, performance or compliance with legal requirements.
Where a change materially affects a paid service or your legal rights, we will provide any notice or remedy required by applicable law.
17. Third-party services
PikMe may rely on third-party services, including app stores, payment providers, hosting providers, analytics services and location-related technologies.
Your use of those services may be subject to separate terms and privacy policies.
We are not responsible for independent third-party services to the extent permitted by law. This does not exclude responsibility for our own acts or omissions or any liability that cannot lawfully be excluded.
18. Suspension and termination
You may stop using PikMe at any time and may request account deletion through the available account settings or by contacting us.
We may suspend, restrict or terminate your access if:
You materially breach these Terms.
We reasonably believe your conduct creates a safety or security risk.
Your account is being used for unlawful activity.
We are required to do so by law or a competent authority.
We discontinue the Service in accordance with applicable law.
Where reasonably practicable and legally appropriate, we will provide notice and an opportunity to address a breach before taking significant action. We may act immediately where necessary to protect users, prevent harm or comply with law.
Termination does not remove obligations or liabilities that arose before termination.
19. Account deletion and retention
You may request deletion of your account.
Following a valid deletion request, we will handle your personal data in accordance with our Privacy Policy and applicable law.
Some information may be retained for a limited period where necessary to comply with legal obligations, resolve disputes, enforce our Terms, maintain security or establish, exercise or defend legal claims.
Content removal and account deletion may not immediately remove copies already lawfully retained in backups, records or systems operated by third parties, although such information will be handled in accordance with applicable requirements.
We will not retain personal data indefinitely without an appropriate lawful basis.
20. Privacy and data protection
Our Privacy Policy explains how we collect, use, store, share and protect personal information.
It also explains your rights in relation to personal data and how to contact us about privacy matters.
Your use of PikMe is subject to our Privacy Policy, which should be read alongside these Terms.
Where we rely on consent for a particular processing activity, that consent will be requested separately where required by law. Agreeing to these Terms does not, by itself, constitute consent to every possible use of personal data or device permissions.
21. Disclaimers
PikMe is provided for social discovery and communication.
To the extent permitted by law, we do not warrant that:
The Service will always be available, uninterrupted or error-free.
User-provided information will be accurate or truthful.
Nearby results will be complete or precise.
Every user will behave lawfully or appropriately.
Any interaction will lead to a friendship, relationship, conversation or meeting.
PikMe does not guarantee another user's identity, intentions or trustworthiness.
Nothing in these Terms excludes a guarantee, condition, right or remedy that cannot lawfully be excluded under applicable law.
22. Limitation of liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to the paragraph above and to the extent permitted by law, PikMe will not be liable for indirect or consequential losses that are not reasonably foreseeable.
If you use PikMe as a consumer, you retain all mandatory rights and protections provided by applicable consumer law. These Terms do not limit those rights.
Where you use PikMe in the course of business, any additional limitations of liability will apply only to the extent permitted by law.
23. Indemnity
If you use PikMe in the course of business, you agree, to the extent permitted by law, to compensate PikMe for reasonable losses, liabilities and costs arising directly from your material breach of these Terms or unlawful use of the Service.
This clause does not require a consumer to indemnify PikMe for losses caused by PikMe's own negligence, breach of contract or other conduct for which it is legally responsible.
24. Changes to these Terms
We may update these Terms from time to time to reflect changes in the Service, our business, applicable law or safety requirements.
We will update the “Last updated” date when changes are made.
Where required by law, or where a change materially affects your rights or obligations, we will provide appropriate notice before the change takes effect.
If you do not agree to revised Terms, you should stop using the Service and may close your account. Any rights you have under applicable law remain unaffected.
25. Governing law and disputes
If you are a consumer resident in the United Kingdom, these Terms are governed by the law of England and Wales, without depriving you of any mandatory consumer protections available under the law of your country of residence.
The courts of England and Wales will have jurisdiction to the extent permitted by applicable law, subject to any mandatory rights you may have to bring proceedings elsewhere.

Nothing in this section prevents you from contacting a regulator or exercising a statutory right.
26. General provisions
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Our failure to enforce a provision does not constitute a waiver of our rights.
You may not transfer your rights or obligations under these Terms without our consent, except where applicable law permits. We may transfer our rights and obligations where permitted by law and where doing so does not unlawfully prejudice your rights.
These Terms, together with the applicable Privacy Policy and any specific purchase terms, form the agreement governing your use of PikMe.
